The Draft Constitution of the People's Republic of China was passed by the Second Plenary Session of the 9th Central Committee of the Chinese Communist Party in September 1970 during the Cultural Revolution. It was shelved because the 4th National People's Congress failed to convene as scheduled that year. After the Lin Biao incident, it was confiscated and destroyed because it included Lin Biao's name.
